Data Processing Agreement

1. Background

This Agreement outlines the terms under which personal data will be processed by Forgemaster AI on behalf of the Company, in compliance with applicable data protection laws as agreed upon at the time of signup.

2. Acceptance of Terms

By using our services and agreeing to this Agreement upon signup, the User consents to the processing of their personal data by Forgemaster AI in accordance with this Agreement.

4. Scope and Purpose of Processing

Forgemaster AI shall process Personal Data only on behalf of the Company for the purpose of providing services as described in the principal agreement between the parties. Additionally, Forgemaster AI may act on behalf of the user in third-party systems to facilitate the provision of these services.

5. Responsibilities of Forgemaster AI

Forgemaster AI agrees to:

• Process Personal Data only in accordance with the documented instructions from the Company.
• Implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
• Ensure that personnel authorized to process Personal Data are committed to confidentiality.

6. Subprocessing

Forgemaster AI may engage Subprocessors to process Personal Data. Forgemaster AI will notify the Company of any changes to the list of Subprocessors and provide the Company with an opportunity to object to such changes.

7. Data Subject Rights

Forgemaster AI shall assist the Company in responding to any requests from data subjects to exercise their rights under applicable data protection laws.

8. Data Breach Notification

In the event of a Personal Data breach, Forgemaster AI shall notify the Company without undue delay after becoming aware of the breach.

9. Termination and Deletion of Data

Upon termination of this Agreement, Forgemaster AI shall delete or return all Personal Data at the Company's request, unless retention is required by law.

10. Data Storage and Usage

Forgemaster AI does not store users' code or use it for AI training or any other activities other than providing the offered service.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Estonia.

12. Amendment

This Agreement may only be amended in writing signed by authorized representatives of both parties.

13. Signatures

By confirming acceptance upon signup, both parties agree to the terms of this Data Processing Agreement.
